Governor Yates

Dear Sir

At our last term at court I obtained a judgement in favor of the state upon a forfeited recognisance for the sum of Five Hundred Dollars. The principal has left the County and the securities are insolvent, the principal Christian Boepple executed to his sureties a mortgage upon real estate of sufficient value to secure them, this they are willing to assign to the state if they are released from the judgement. Judge Davis thought I had better take the mortgage and release them as it was for the best interest of the state to do so but he also advised me before releasing them to get written authority from you to do so for my own protection.

I have written a paper enclosed which I suppose will answer
