State of Illinois Morgan County Circuit Court May term AD 1834 James E. Waldo Daniel Waldo, and George Waldo trading and doing business under the name and firm of James E. Waldo were summoned to answer Charles Jones of a plea of trespass on the case, and thereupon the said Charles Jones complains for that whereas the said James E. Waldo Daniel Waldo, and George Waldo by and under the name and firm of James E Waldo & Co heretofore to wit on the 11th day of March 1834 at Meredosia in the County and circuit aforesaid made their certain note in writing bearing date the day and year aforesaid and thereby then and there acknowledged to be due on demand to the said plaintiff the sum of one hundred and thirty dollars with use (meaning interest) for value received, and then and there delivered the said note to the said plaintiff, by [mens?] whereof and by force of the Statute in such case made and provided the said defendants became liable to pay to the said plaintiff on demand the said sum of money in the said note specified according to tenor and effect of the said note, and being so liable, they, the said defendants in consideration thereof afterwards to wit on the day and year aforesaid at the county and circuit aforesaid undertook, and then and there faithfully promised the said plaintiff to pay him on demand the said sum of money in the said note specified according to the tenor and effect thereof. And for that whereas also afterwards to wit on the day and year last aforesaid in the county and circuit aforesaid the said James E. Waldo Daniel Waldo and George Waldo by and under the name and firm of James E. Waldo & Co were indebted to the said Charles Jones in the further sum of one hundred and thirty dollars for so much money by the said Charles Jones


before that time lent and advanced to the said defendants at their special instance and request, as well as before that time for money had & received by the said defendants to and for the use of the said Charles Jones and being so indebted afterwards to wit on the day and year last aforesaid they the said James E. Waldo, Daniel Waldo and George Waldo by and under the name and firm of James E. Waldo & Co undertook and faithfully promised the said Charles Jones to pay the same when thereunto requested. Yet the said defendants have not paid the same or any part thereof though thereunto often requested. Wherefore by reason of the premise and each of them the said Charles Jones saith that he is injured and has suffered damages in the sum of one hundred and fifty dollars to recover which &c Charles Jones by his attorney S A Douglas A copy of the Note [sued?] upon "Meredosia March 11th 1834 Due Charles Jones one hundred and thirty dollars on demand with use for value Recd of him" (signed) "James E.
