To the Honorable the Judge of the Sangamon
Circuit Court in Chancery Sitting Humbly
complaining sheweth unto your Honor your
Petitioner Elizabeth Musick Widow of
Samuel Musick deceased, who at the time
of his death resided in the County of San
gamon.
That some time in the month of
January and she thinks in the year 1831 in
the County of Sangamon State of Illinois
your Petitioner was legally married to Samuel
Musick since Deceased, That after their
said mariage Your Petitioner and the
said Samuel Musick lived together as
Man and Wife, in the County of Sangamon,
until the Death of the said Samuel
which happened on the 28th Day of May,
in the Year of our Lord One Thousand
eight Hundred and Thirty Six. Your Pe
titioner would further state that the said
Samuel Musick, husband of this Petitioner
as aforesaid, at the time of his death
was seized of and pofsefsed and had
title in Fee Simple, to the following lands
and tenements lying in the County of
Sangamon State of Illinois known desig
nated and described as follows To Wit
The South West fourth of the South West Quarter
of Section Five; The east Half of the South East
Quarter of Section Six; The South East Quarter
of Section Seven; The West Half of the South
West Quarter and the West Half
of the North West Quarter of Section Eight
all in Township Nineteen North of Range
Four West of the Third Principal Meridean.
Your Petitioner would further State that
the said Samuel Musick at the time of his
death left the following heirs, To Wit Abraham
Music Samuel Musick Herrod Musick John
Musick, Reidents of Sangamon County, Oba
diah Sturdevant and Cynthia his wife
John Sturdevant and Nelly his wife Robert
Kelso and Jane his wife, of Tazewell County
John Bridges & Polly his wife of Sangamon
County, and Grant Musick Lewis Musick
and Eliza Musick of Sangamon the three
last being Minors. Your petitioner prays
that the above named Heirs may be made
Defendants to this Bill and that they may
be required to answer on oath all and
singular the allegations of this Bill
Your Petitioner would further state that
the "homestead" or "dwelling house" of her
said Husband Samuel Musick Deceased
was situated on the South West Fourth
of the South West Quarter of Section Five,
Township Nineteen North of Range four West
above named. Your Petitioner would further
State that notwithstanding her husband has
been long since dead as aforesaid, and
died seized of the Lands aforesaid
Yet her Dower, as the widow of the said
Samuel Musick in and to said lands has
not as yet been set apart to her;
In Tender consideration of all which
Premises, Your Petitioner prays that her Dower
in and by a Decree of Your Honorable
Court may be set apart to her & to the lands
described as aforesaid. And that Commifs
sioners may be appointed according to the
Statute in such case made and provided
to set off to your Petitioner by metes & bounds
One Third Part of the lands above described
including the dwelling or homestead of her
said Husband at the time of his death
described as aforesaid And that Your
Honor will grant such other and further
Relief as the Equity of her case demands.
She prays for the writ of Subpoena and
as in duty bound she will ever pray & c.
