Hoffman Lieut Governor of the State of Illinois Nov. term of Supreme Court A.D. 1863 The well known case of Marbury vs Madison 1 branch 137 in 1 Condensed Reports U.S. Supreme Court pages 276 279, 280 decided Feb. term 1803 settled the law under the Constitution of the United States that a mandamus would not be against the Executive branch of the National Government, nor even against a Secretary of State of the United States, the appointee and one of the advisers of the President, where the Secretary's acts were “political” and within the scope of executive functions and were not strictly ministerial. The same rule clearly <hr /> applies so far as the Executive branch of the Government of Illinois is concerned The Governor as the Executive is not subject to mandamus from the Courts. The Lieut. Governor occupies a double relation to the State both Executive (at times) and Legislative when Presiding over the senate. He is not subject to a Mandamus in either capacity. Chase a counselor in this City) for the pardon of John Alias Jack Maginnis and [Burchard?] Rooney who were convicted of an assault upon one of our Police Officers and Sentenced at the Juy Term of the Recorders Court for one year in the County Jail. Mr. Chase advises me that he has as yet received no communication from you in relation to the matter. I have confirmed fully with the Police officers who claimed to have been assaulted and permit me to say that having had cognizance in relation to the facts as to those parties I concur fully with judge Van Buren in the request that they be pardoned and respectfully ask you to grant them a pardon immediately You will be kind enough if the request is granted to forward papers to H.M. [Vernon?] of the 14th U.S. Infantry, now with Gen Meade has faithfully served his country almost from the commencement of the present civil war, has passed through many of the severest battles, beginning with that of Bull Run and closing with the one fought last Saturday morning He has undergone many hardships and being of a maturaly slender constitution it has gone hard with him. If he could be ordered on light duty for a short time it would be of a great relief to him. May I not ask of you this favor to employ a little of your influence to have the boy ordered on recruiting or mustering service for a short time? By so <hr /> doing you will lay me under obligations which I shall not soon forget. He would like to be ordered to Illinois but would be perfectly satisfied to be relieved by almost any change. Chattanooga Tenn Nov 12th /63 I am sorry to be called upon to state to you a sad incident that took place a short time since We were on picket guard the first of this month and the orders were to have no fires and when the relief that Silas was on came off there was some live coals lying where the fire had been and some of the boys stired them up and the captain that was in command of the regiment saw it he rode up and ordered them to put it out and the Lieutenant that was in command of the guards said he had ordered it out and the Capt said if he was in command of the guards he would tie up and buck and gag every God dammed man that touched it and some of the boys said they would like to be bucked and gaged with hard tack and the Captain then rode off the next morning we come to come to camp and the boys were talking about what the Captain said and some of them called him names and spok pretty hard of him and while they were talking Ed Mulligan Seargeant Major of the Regiment came along and he went to Capt Taggert the regiment command and reported Silas for using abusive language and he Silas was arrested and the charges was prefered against him for which he was court martialled and senteced to have all his pay <hr /> [bounty?] Stopt now due or that may become due him forfeited and to be confined in the military prison at Nashville at hard labor the remainder of his term of Service the boys all say he is innocent of the charges that was preferred against him the Sergeant Major was the only evidence against him and that it was melitiously done we want his sentence commuted if possible we all want him reperieved as we all believed him to be innocent and as good a Soldier as we had in the Co. Infantry I wish to ask you your cordial recommendation of what he wishes. Major McC. in 1862 was the editor of a Douglas Democratic paper in Hancock Co. He aided the government in raising men for Regt after Regt. and finally abandoned his business and raised a company for 188th.
