I send you the list as requested. It was prepared promptly and taken to your office yesterday and was among the papers I laid on the top of your desk yesterday P.M.  The list is as perfect as I can make it.  You will notice that I have but little information about the strength of these regiments on their return as there have but few reported their strength. I think it safe to assume that they will average 350 &amp;amp; possibly 400 per regiment. You will also notice that 18 regiments have arrived.  The balance may all return this month - probably not.  Some are officially &amp;amp; some unofficially reported as re-enlisted but is almost certain that all on list have re-enlisted.  My recruits do not have the strength of the old regiment when they left the state.  The numbers given include all who have joined at or since their organization.  I did not furnish the list you referred to &amp;amp; found. Selby yesterday [illegible] if other regiments had re-enlisted &amp;amp; I mention them [illegible]

&lt;/p&gt;
&lt;pre&gt;An intense headache presents me from imposing upon you the trouble of reading a somewhat elaborate train of thought, which the letter of Dr Fithian and your letter to me, respecting McCoy, has started in my mind.
&lt;/pre&gt;
&lt;p&gt;The Dr letter is characteristic.  I think Mr McCoy is impulsive, excitable, but a generuos, kind hearted man, one that would divide his boots and share his last loaf with a poor soldier.  zi had never seen him previous to  Wednesday last.
&lt;/p&gt;&lt;p&gt;I thank you for your kind invitation, and trust I shall be in a better plight tomorrow.  please destroy this and oblige.

He acted the part of your friend in the matter - so the Judge &amp;amp; myself think - Taylor is as hostile as ever and will never do you justice  I saw him today in conversation with one H N Bryant who has

I had expected to go to Springfield today; but believing a statement of facts all that is necessary, have concluded to transmit the same in writing. I inclose communication addressed to Post Masters, which will explain to your Honor the plan contemplated. If in your judgement the plan is judicious, and would likely prove successful, in time to secure present Bounty; please fill the blanks, and telegraph the same to Tribune and Democrat without delay and hand a copy to the Journal, 
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;also let it have the benefit of your official sanction, and large influence. 
&lt;/p&gt;&lt;p&gt;Of course I would like to have the Colonelcy, but am willing for the center or northern part of the state to have that office; Being the originator of the movement, I think it would not be presumption to ask, and expect the Lieut Colonelcy, or Major's position. The Democrats of this county have furnished a Col. and a Lieut Col. It seems to me that the Republicans ought to be allowed at least a Lieut Col. or Major. 
&lt;/p&gt;&lt;p&gt;The plan, if successful, will doubtless secure a Regt of earnest, working, and I trust fighting Republicans. 
&lt;/p&gt;&lt;p&gt;If you decide that we have time, and that the plan is judicious, and would likely prove successful, please act promptly.

&lt;/p&gt;&lt;p&gt;I wish for the present that you would appoint Swan - I know him well &amp;amp; that he is the man - if he does not accept (as I fear he will not) we can try Crawford--Forrest was appointed without any pay supposing as I did and still believe that the cases of need were few and I knew that Swan  &amp;amp; other Ilinoisians had got up an association to take care of them--Of course I do not reflect on Crawford--

I have been annoyed a great deal by letters from Washington--seeking agencies but I have known that there were 150 places where they were more needed, but as other states have agts at Washington and brag over us--and as there are occasionally cases there I had decided to appoint Swan-
&lt;/p&gt;&lt;p&gt;-He (Swan) is a highly moral and good man.

&lt;/p&gt;&lt;p&gt;I have received the following order from the Provost Marshal General of the United States, dated January 29th, 1864, viz:
&lt;/p&gt;&lt;p&gt;"Direct  your officers not to forward, pay, or give credit for recruits whose youth or old age, in their judgment, unfits them for service.  Hold all such men, and forward full report of them here for orders."
&lt;/p&gt;&lt;p&gt;The object of this order is to keep all boys and old men out of the army.  The Government wants none but strong, able-bodied, serviceable men.  Great evil has resulted from want of care on this point, and greater caution must be observed in future.  Every unserviceable man sent to the field is a positive loss and injury to the Union cause.
&lt;/p&gt;&lt;p&gt;In all cases where you are satisfied that a recruit presented to you would not make an effective soldier, by reason either of youthful immaturity or of advanced age, you will peremptorily refuse to enlist him, or to muster him into service, or to forward him to the Geaeral Rendezvous.
&lt;/p&gt;&lt;p&gt;Should recruits of this description elude the vigilance of Recruiting officers, and be forwarded to the Rendezvous, Mustering and Disbursing officers are forbidden to muster them into service, or pay them.  No District, County or Town will received credit for such recruit.

And have been wounded four times, And now have Suffered the Amputation of my right leg. I am the onley 1st Sergent in the Regiment. that has not received promotion in their turn. Being a Stranger in the Regt. and laying in the Hospital Wounded. with out Friends or Money influence, I have been over looked and others appointed in my stead With the promise to me of their influence for a position in the Invalid Corps

&lt;/p&gt;&lt;p&gt;I have not seen Taylor since you left Yesterdy Henry saw him he told Henry he would fight the thing to the bitter end - To day Henry Came in &amp;amp; told me Taylor had melted down - he wants to meet Henry &amp;amp; my self tomorrow morning &amp;amp; see if the Matter cant be arranged so I think the matter looks more encouraging

&lt;/p&gt;&lt;p&gt;Should Taylor propose that you give him 2 or 3 thousand dollars &amp;amp; settle the whole matter I think as your Friend I should advise you to accept it - I think this us just what he will propose to us tomorrow he intimated to Ferry that he would take 5000$ and settle - I should not advise under any circumstances to give him that much.  The fact is Taylor finds he is cornered - any respected lawyers will tell

&lt;/p&gt;&lt;p&gt;There is no use is mincing matters---if ingrates turns traitors, let them understand that they are known and that a traitors [doom?] is before them. Ferry thinks he has your confidence so far that it cannot be shaken, but when he finds that you know him, he will quail and come up to the mark.

&lt;/p&gt;&lt;p&gt;I wrote him this morning to come &amp;amp; see me without fail on Monday. I am pretty well satisfied that he has "gone back." on me, &amp;amp; intends to keep what he has got. I felt deeply hurt this morning to learn that Babcock on Thursday was blowing around the Tremont house.  That I was in collusion with Taylor; that I was against you; that I could fix Taylor up if I wanted to.
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;&amp;amp;c &amp;amp;c.  Miss [Sharper?] has made [illegible] the slightest foundation in the [illegible] &amp;amp; I cannot imagine the motive of Babcock.  Except he desired to create distrust &amp;amp; ill feeling between you &amp;amp; myself. I cannot conceive how I could be in collusion with Taylor as against you.  The money you have got.  and in the event of a [fight?] my evidence would support your right to it.  This I told Taylor, Larned, Parks &amp;amp; others.  In fact I informed them all, that Taylor had not one chance in a thousand to recover a cent of the money.  This opinion in connection with the [cause?] that I presumed in the matter has found Tayler against me.  that extent
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;that he will not even come to see me &amp;amp; the result will be that I shall get no answer from him. I shall lose what I advanced.  &amp;amp; yet will be charged with being in a conspiracy with him against you.

&lt;/p&gt;&lt;p&gt;I have not seen Taylor or heard from him since you left.
&lt;/p&gt;&lt;p&gt;I wrote him this morning to come &amp;amp; see me without fail on Monday. I am pretty well satisfied that he has "gone back." on me, &amp;amp; intends to keep what he has got. I felt deeply hurt this morning to learn that Babcock on Thursday was blowing around the Tremont house.  That I was in collusion with Taylor; that I was against you; that I could fix Taylor up if I wanted to.

&lt;hr /&gt;
&lt;p&gt;&amp;amp;c &amp;amp;c.  Miss [Sharper?] has made [illegible] the slightest foundation in the [illegible] &amp;amp; I cannot imagine the motive of Babcock.  Except he desired to create distrust &amp;amp; ill feeling between you &amp;amp; myself. I cannot conceive how I could be in collusion with Taylor as against you.  The money you have got.  and in the event of a [fight?] my evidence would support your right to it.  This I told Taylor, Larned, Parks &amp;amp; others.  In fact I informed them all, that Taylor had not one chance in a thousand to recover a cent of the money.  This opinion in connection with the [cause?] that I presumed in the matter has found Tayler against me.  that extent

&lt;hr /&gt;
&lt;p&gt;that he will not even come to see me &amp;amp; the result will be that I shall get no answer from him. I shall lose what I advanced.  &amp;amp; yet will be charged with being in a conspiracy with him against you.

Sir:
I beg leave to acknowledge the receipt of your communication of the 17th instant in relation to the reception of the convicts condemned by sentence of Naval General Court Martial. At the same time I received a communication from James M. Pitman Esqr. warden of the State Penitentiary, dated Joliet, Decr. 15. Mr. Pitman agrees to receive any prisoners sent there on the same terms as other prisoners heretofore received. 
I will send the prisoners, but I would like it understood that the Secretary of the Navy be informed if any action should arise out of this imprisonment or a writ of Habeus Corpus be issued for the possession of the persons of the 
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;convicts, so that the Secretary may remove them to another place.
The Law is as follows:
In any case where a naval court martial is authorized to adjudge the punishment of death it may sentence the person convicted to imprisonment for life, or for a stated term at hard labor and such sentences of imprisonment and hard labor may be carried into execution in any pension or penitentiary under the control of the United States, or the use of which shall be allowed by the legislature of a State, and persons convicted by a court martial and imprisoned in the prison or penitentiary of any State or Territory shall in all respects be subject to the same discipline and treatment and under the same control as convicts sentenced by the courts of the State or Territory in which such prison or penitentiary is situated.

&lt;/p&gt;&lt;p&gt;Your favor of the enclosure as stated is received we have this day  recvd the check of A.B. Taylor agent enclosed in your letter amting to 10,000 The more effective to protect your interest we have had the check Protested - as Matters  now stand we could not pay the check nor place it to your Credit - for we have been served with a written notice forbidding us from doing so - we shall hold the funds and refuse all checks of Taylor untill this Matter is settled - we shall be very happy to do all in our power to protect you - but under the Circumstances could not in our own responsibility
