                <text>Abraham Lincoln completes a mortgage deed on Maria Bullock's property. The sale of the land amounted to $180, with $18 paid in cash and remainder in to be paid in two annual installments at interest of 6%/annum.  Viney makes the first payment for which Lincoln writes a receipt on November 5, 1856. However, a year later, Viney fails to pay the second note when it is due.  In 1857, according to Lincoln, Viney permits the lots to be sold for the 1856 taxes and allows the purchaser to pay the 1857 property tax. In order for Bullock to preserve her security, she must redeem the property from the tax sale, paying double the amount for which the land was originally sold, and the single amount for 1857 and pay the taxes for the year 1858. This is one of nine documents in Bullock v. Viney.</text>

The record from August 1857 until August 1860 are in Lincoln's hand. From September 1861 until May 1864 the notations are in the hand of Robert Irwin, a surrogate for Lincoln.</text>

of her father, leaving her husband surviving, but no issue, and also owning land in
Iowa.  My opinion is asked as to how, or to whom, this land descends.
I have to judge by the Iowa laws, as I find them in the State House here in Illinois.
In the "Code of Iowa" enacted in 1857, on page 214 I find
Sec "1410.  If the intestate leave no issue the 
one half of his estate (including the dower of 
his wife) shall go to his father, and the other 
half to his wife, and if he leave no wife nor
issue the whole shall go to his father".
Sec. "1411.  If his father be previously dead, the 
portion which would have fallen to his share 
by the above [illegible] shall be disposed of
in the same manner as though he had outlived
the intested and died in the possession
and ownership of the portion thus falling to
his [illegible] [illegible]"
Again on page 215
Sec. 1421.  All the provisions hereinbefore made in relation to the widow of a deceased
husband shall be applicable to the husband of a deceased wife.  Each is entitled to
the same rights of dower in the estate of the other and like interests shall in
the same manner descend to then respective heirs.  The estate by courtesy is hereby
abolished.
The above Sec 1421, was, in 1853 so amended
as to read.
Sec "1421.  All the provisions hereinbefore made in relation to the widow of a deceased husband shall

&lt;p&gt;be applicable to the husband of a deceased wife.  The estate by courtesy is hereby abolished".
So far as I have the opportunity I have examined the decisions of the Supreme court of Iowa and find nothing in them on the question
nor do I find any other statutory [alteration?].  I therefore think one half of the land goes to Mrs. Fahnestock's husband and the other
half to her father's heirs.
The Iowa Statutes and Supreme Court decisions will probably be found at Harrisburg Pa.
I will add that it would be prudent to get the opinion of a good lawyer in Iowa, being
careful to state to him correctly the facts of the
case particularly that Mrs. F. died without children

                <text>&lt;p&gt;Mrs. Mary Fahnestock died without a will after the death
of her father, leaving her husband surviving, but no issue, and also owning land in
Iowa.  My opinion is asked as to how, or to whom, this land descends.
I have to judge by the Iowa laws, as I find them in the State House here in Illinois.
In the "Code of Iowa" enacted in 1857, on page 214 I find
Sec "1410.  If the intestate leave no issue the 
one half of his estate (including the dower of 
his wife) shall go to his father, and the other 
half to his wife, and if he leave no wife nor
issue the whole shall go to his father".
Sec. "1411.  If his father be previously dead, the 
portion which would have fallen to his share 
by the above [illegible] shall be disposed of
in the same manner as though he had outlived
the intested and died in the possession
and ownership of the portion thus falling to
his [illegible] [illegible]"
Again on page 215
Sec. 1421.  All the provisions hereinbefore made in relation to the widow of a deceased
husband shall be applicable to the husband of a deceased wife.  Each is entitled to
the same rights of dower in the estate of the other and like interests shall in
the same manner descend to then respective heirs.  The estate by courtesy is hereby
abolished.
The above Sec 1421, was, in 1853 so amended
as to read.
Sec "1421.  All the provisions hereinbefore made in relation to the widow of a deceased husband shall

&lt;p&gt;be applicable to the husband of a deceased wife.  The estate by courtesy is hereby abolished".
So far as I have the opportunity I have examined the decisions of the Supreme court of Iowa and find nothing in them on the question
nor do I find any other statutory [alteration?].  I therefore think one half of the land goes to Mrs. Fahnestock's husband and the other
half to her father's heirs.
The Iowa Statutes and Supreme Court decisions will probably be found at Harrisburg Pa.
I will add that it would be prudent to get the opinion of a good lawyer in Iowa, being
careful to state to him correctly the facts of the
case particularly that Mrs. F. died without children

                <text>Lincoln's colleague John Olney asks him to evaluate the likelihood of a favorable result to a legal case Olney is considering.  Olney, a partner in the law firm of Olney &amp;amp; McAtee in Shawneetown, Gallatin County, Illinois, is active in Republican Party politics, serving as a delegate to the state party convention in 1858. It is possible that the case under consideration is Daniel Doup vs. Ninian Primm and Samuel C. Gibson.  Lincoln and Herndon previously served as Doup's attorneys regarding some Illinois real estate transactions.  Doup died in the middle of the business in June 1857, leaving a wife and other heirs. At that time, Olney was drawn into some aspect of Doup's affairs.  Lincoln declines to predict the final solution of the enterprise and indicates an appropriate fee for his opinion. Although Lincoln tells Olney that there is no fee for his advice, Lincoln ended up being paid partly in land in Gallatin County. Two years later, Olney runs as a Republican presidential elector, and on June 27, 1867, is selected to the bench of Illinois's 19th circuit court.</text>

It is the first we have received from home Since our arrival here - Business has improved considerably during my first week but not enough for me to be greatly interested - We hope to do much better next week -- Lizzy played for the Benefit on Friday night and was finely received and warmly applauded I was taken with a [illegible] Hoarseness on Saturday last night, and am but little better today - I hope I shall not suffer with it tomorrow night in "Outahlauchet," They bring out "Putnam" at the other house. We shall have to work hard, and

to Baltimore it was too late

this time, for I only came
from the Country to day,
and am dreadful tired -
Rosalie &amp;amp; I went up on
tuesday - to move all our
things out - for I have Rented
the House &amp;amp; Farm for seven
years - at [125?] dollars a year
its little enough - but I think it

&lt;p&gt;better than having the House
shut up - and the Men who
have taken it promise to improve
the place. &amp;amp; they pay the Taxes also,
it is a perfect Wilderness Now,
the Negroes have been there

playing now in Richmond
I found a letter awaiting
my return - &amp;amp; he says
his first night - last Monday 
- was very good - and he
thinks he will do a fine
business - John is in Richmond

get along first rate - he plays
some very good parts - he
played Richmond in Baltimore

My dear June
I hope this will find
you in good health. I think its 3
mails that I have missed writing
to you. &amp;amp; I am afraid Edwin
has done the same. When the [last?]
mail left he was just leaving
Washington - &amp;amp; when he came
to Baltimore it was too late
&amp;amp; I was almost too late
this time, for I only came
from the Country to day,
and am dreadful tired -
Rosalie &amp;amp; I went up on
tuesday - to move all our
things out - for I have Rented
the House &amp;amp; Farm for seven
years - at [125?] dollars a year
its little enough - but I think it
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;better than having the House
shut up - and the Men who
have taken it promise to improve
the place. &amp;amp; they pay the Taxes also,
it is a perfect Wilderness Now,
the Negroes have been there
a year - &amp;amp; have paid me
nothing yet.  Edwin is
playing now in Richmond
I found a letter awaiting
my return - &amp;amp; he says
his first night - last Monday 
- was very good - and he
thinks he will do a fine
business - John is in Richmond
too &amp;amp; Edwin thinks he will 
get along first rate - he plays
some very good parts - he
played Richmond in Baltimore 
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;to Edwins Richard - &amp;amp; he acted
very well - &amp;amp; looked well &amp;amp;
his Voice is so like Edwins
you could scarcly tell them
apart - [Dave Anderson?]
stayed 3 week with Edwin
part of the time they went
up to the Farm - then he
Returned to New York - I
did hear he was going back
to California - I believe he
is sorry he left there -
When he first came he talked
of going to England - but I think
he has given up that Notion.
I hope dear little Mary is
got quite well, give our
loves to her &amp;amp; lots of
Kisses I should like to 
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;see her very much - but
I suppose you never intend
to come here again - God
bless you my dear Boy. I
wish you were nearer to 
me so I could see you
sometimes - Joseph has 
a Situation as assistant Treasurer
in Baltimore, at the [Dobleday?] St
he receives 4 dollars a week,
it just about keeps him in [cigars?],
John [got 11?] - I hope you
will write by return, for I
am always anxious to hear
from you. You must Excuse
the Shortness of this, as I am
[hardly?] got over my journey,
