&lt;/p&gt;&lt;p&gt;I respectfully acknowledge the receipt of your communication enclosing copies of instructions, issued from time to time, from your office to Col. Wm  Weer, 10th Kan. Vols. late commanding this Post and requesting a report of the conditions in which I found the records of this Post.
&lt;/p&gt;&lt;p&gt;I have to report that I arrived here on the 26th of April, and on the 27th I assumed command and made an inspection of the Prison, Offices, Quarters, and Hospital and I have since that time, more leisurely and thoroughly inspected all that pertains to the Post.
&lt;/p&gt;&lt;p&gt;I find the Prison in bad repair and police -- the Prison hospital-roof leaking so badly as to make it almost uninhabitable, and the wall, on the north side weak and tottering. On a representation of these facts to the Com'd'g Officer
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;of the Dept. of the Missouri, he instructed the Chief Quartermaster of the Dept to have the necessary repairs made, and the work has been promptly commenced.
&lt;/p&gt;&lt;p&gt;The Quartermaster and Commissary Depts of the Post are conducted in a satisfactory manner.
&lt;/p&gt;&lt;p&gt;The records at the Prison, and at the Head Quarters were in a most confused and defective state; at the Prison, one book which has been used by successive Commanding Offices, purposes to contain a list of all the prisoners who have been received at the Prison with their description and what became of them.  It contains the names of many not here now, and yet does not record the final disposition made of them.
&lt;/p&gt;&lt;p&gt;Many who have been in Prison are not recorded at all, and there are some still in the Prison whose names do not correspond with the records, or are not recorded.
&lt;/p&gt;&lt;p&gt;I have directed new record books to be started, one for each class of prisoners; which will contain all that I found in Prison when I took command.
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;and all received by me since -- and from the old record books, I will do the best possible to give all information that may be required.
&lt;/p&gt;&lt;p&gt;Retained copies of rolls and returns are in many instances lost and mislaid, and the records of H'd Quarters are very deficient; - copies of correspondence have been most imperfectly kept, and many important letters and instructions are reported by Col. Weer, to have been stolen from his desk.
&lt;/p&gt;&lt;p&gt;I shall go on under the instructions contained in your circular of April 20th 1846 and the copies of instructions to Col. Weer furnished by your Office, and get the entire business of the Post systematically arranged and organized and I hope in a short time to be able to report a more satisfactory state of affairs.

&lt;/p&gt;&lt;p&gt;Respectfully returned to the Secretary of War. It is set forth in the within affidavit (and accompanying papers,) that Hiram Stanton a deputy Provost Marshall has been, since April last, confined in the County jail of Marion Co. Illinois, upon a charge of murder, and that the homicide upon which the charge was based was committed by him while in the discharge of his duty, in arresting by him the order of the Provost Marshall at Cairo, one Newkirk, for treason and disloyalty. It is added that the arrest was resisted by Newkirk and another, who fired upon and wounded Stanton before he himself fired upon them. Under these circumstances it is believed that this party is entitled to have his case passed upon by a military court, as being in the military service of the United States, and therefore included within the provisions of Section 30, ch. 75, of Act of 3 March, 1863. It has heretofore been ruled that this section confers an exclusive jurisdiction upon military
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;courts for the trial of the crimes therein mentioned, when committed by persons in the military service and subject to the articles of war.
&lt;/p&gt;&lt;p&gt;A deputy Provost Marshall is an officer appointed by virtue of Circular No. 19 of War Department, Prov. Mar. Gen's. office, of June 8th. 1863. His duty is to assist the District Provost Marshall in the performance of the duties devolved upon him by law, and particularly in causing the arrest of deserters. He is appointed to assist the Provost Marshall simply because the latter is supposed to be unable to perform effectually the numerous and pressing duties imposed upon him. He therefore acts in the place and stead of his principal, and being thus the substitute and representative of the latter, he should be held bound to the same military control, as well judicial as executive. In accordince with previous rulings of this Bureau he would therefore be held triable by Court Martial for wrongful acts done in the course of the performance of his official duties, and would be viewed as in the military service of the United States.
&lt;/p&gt;&lt;p&gt;It is therefore advised that the Governor of Illinois be requested to turn over Stanton to the
&lt;/p&gt;

&lt;p&gt;[Nov 29 1964]
&lt;/p&gt;&lt;p&gt;military authorities for trial upon a charge of murder before a military tribunal. In a number of similar cases requests of this character have been addressed to the Governors of States, and, except in a single instance, (as far as the knowledge of this Bureau extends,) have been favorably entertained, and at once acceded to.

&lt;/p&gt;&lt;p&gt;Respectfully returned to the Secretary of War. It is set forth in the within affidavit (and accompanying papers,) that Hiram Stanton a deputy Provost Marshall has been, since April last, confined in the County jail of Marion Co. Illinois, upon a charge of murder, and that the homicide upon which the charge was based was committed by him while in the discharge of his duty, in arresting by him the order of the Provost Marshall at Cairo, one Newkirk, for treason and disloyalty. It is added that the arrest was resisted by Newkirk and another, who fired upon and wounded Stanton before he himself fired upon them. Under these circumstances it is believed that this party is entitled to have his case passed upon by a military court, as being in the military service of the United States, and therefore included within the provisions of Section 30, ch. 75, of Act of 3 March, 1863. It has heretofore been ruled that this section confers an exclusive jurisdiction upon military
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;courts for the trial of the crimes therein mentioned, when committed by persons in the military service and subject to the articles of war.
&lt;/p&gt;&lt;p&gt;A deputy Provost Marshall is an officer appointed by virtue of Circular No. 19 of War Department, Prov. Mar. Gen's. office, of June 8th. 1863. His duty is to assist the District Provost Marshall in the performance of the duties devolved upon him by law, and particularly in causing the arrest of deserters. He is appointed to assist the Provost Marshall simply because the latter is supposed to be unable to perform effectually the numerous and pressing duties imposed upon him. He therefore acts in the place and stead of his principal, and being thus the substitute and representative of the latter, he should be held bound to the same military control, as well judicial as executive. In accordince with previous rulings of this Bureau he would therefore be held triable by Court Martial for wrongful acts done in the course of the performance of his official duties, and would be viewed as in the military service of the United States.
&lt;/p&gt;&lt;p&gt;It is therefore advised that the Governor of Illinois be requested to turn over Stanton to the

Johnson M.D. of Chicago, recommending me to some post in the medical department of the army: Expressing a preference for a hospital over that of a regiment, you suggested that I should telegraph to Dr Simmons, Medical Director at Cairo, inquiring whether there was a vacancy in the hospital there; I done so immediately and waited a sufficient time for a reply, but recd none: I then returned home by way of St Louis, and whilst there, addressed a letter to him asking an answer to be addressed to this place, but up to this time, have heard nothing from him. Signifying my intention to enter the army, to some of my friends at Chicago last April, they gave me the following testimonial:

&lt;/p&gt;&lt;p&gt;The undersigned Physicians &amp;amp; Surgeons of Chicago, understanding that Dr. J. J. Lescher is making application for the office of Surgeon in the U.S. Army, take great pleasure in

For the past several years I was much engaged in trade, and during the late presidential canvass, I paid attention to nothing outside of the glorious cause of republicanism, consequently, I had become rusty in the technicalities of my profession, - otherwise, I should have claimed grade No 1 Surgeon: However, Dr Johnson told me that out of near 400 up to the time of my examination, but 16  had passed a better, or higher grade than myself.
&lt;/p&gt;&lt;p&gt;With 21 years practice in the Wabash Valley, and the fore-mentioned testimonials, I feel that I am deserving of some consideration at your hands, in the line of my calling. If party labor would add to my claims, I might say that the part which I took in the late canvass gained me an enmity on the part of what may now be called the Order of K. G. C. in this County, to an extent almost demoniac, - endangering my life and my property. I could have avoided reaping this storm of bitterness, but I preferred advocating what I esteemed more worthy than the good will of men whom I despise.
&lt;/p&gt;&lt;p&gt;I have well-nigh exhausted my ingenuity in seeking a vacancy in a regiment or hospital. I know not how to find them. I now appeal to you, asking you to assign  me a position if it lays in yr power.

&lt;/p&gt;&lt;p&gt;Fourteen mos ago I left Peoria Ills. went to Vicksburg Mifs was engaged in Vicksburg Miss as clerk in the Com Sub Department under the direction of Capt J. F. Wilson CS
&lt;/p&gt;&lt;p&gt;In April last, I went to Chicago Ill where I have since resided tis my home  I am engaged

Byrn (mcht) 170 Lake St I am enrolled there and have stood my [chace?] for the Draft in 1" ward  And I am Drafted also in Peoria Ill in 2nd ward and hired a substitute for ($900.00) nine hundred Dollars to take my place. Why I complain is when in July last I wrote to R. A. Yoe Asst Prov Marshall of Peoria requesting him to erase my name from the "List" in Peoria Ills as I was then enrolled in Chicago (my home) and was subjected to the Draft in the 1st ward but he did not answer my

&lt;hr /&gt;
&lt;p&gt;letter nor did he do anything towards having my name erased from the enrolling List the carelessness of which cost ($900.00) nine hundred Dollars.  Peoria is not my home nor has it been since Aug 5" 1863 I ask is it not in the Power of Some one "in Authority" to award justice yet to me. Tis the fault of the Asst Provost Marshal of Peoria and not mine certainly  I have been very unjustly dealt with.

&lt;/p&gt;&lt;p&gt;Fourteen mos ago I left Peoria Ills. went to Vicksburg Mifs was engaged in Vicksburg Miss as clerk in the Com Sub Department under the direction of Capt J. F. Wilson CS
&lt;/p&gt;&lt;p&gt;In April last, I went to Chicago Ill where I have since resided tis my home  I am engaged
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;with Thos P. Byrn (mcht) 170 Lake St I am enrolled there and have stood my [chace?] for the Draft in 1" ward  And I am Drafted also in Peoria Ill in 2nd ward and hired a substitute for ($900.00) nine hundred Dollars to take my place. Why I complain is when in July last I wrote to R. A. Yoe Asst Prov Marshall of Peoria requesting him to erase my name from the "List" in Peoria Ills as I was then enrolled in Chicago (my home) and was subjected to the Draft in the 1st ward but he did not answer my
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;letter nor did he do anything towards having my name erased from the enrolling List the carelessness of which cost ($900.00) nine hundred Dollars.  Peoria is not my home nor has it been since Aug 5" 1863 I ask is it not in the Power of Some one "in Authority" to award justice yet to me. Tis the fault of the Asst Provost Marshal of Peoria and not mine certainly  I have been very unjustly dealt with.

&lt;p&gt;if our soldiers get Home they will do something in this Fulton Co. I suppose I need not urge it on you the necesity of having a good many of our Soldiers back at the Election as I knowe you must be aware of the almost vital importance to the County of carrying this State at coming Elections I believe the cost of a Battle by Grant or Sherman would not be so bad to the county if you had not been Elected we should have had the worst Kinde of a civil War for the last 2 years in our state you and every other influential Man in the state should see to it in time that our Soldiers

&lt;/p&gt;&lt;p&gt;&amp;amp; as several States by vote of the people &amp;amp; their Legislature have ordered, that their soldiers in the field shall vote &amp;amp; as I believe, the Constitution of our State with a liberal Constitution will warant our Soldiers to vote. therefore I would respectfully recomend - that you as Commander in Chief of the forces of Illinois - &amp;amp; as Governor of Illinois - issue a general order - instructing the Commanding Officer of Each Illinois regt. to have his - Regt Cast their votes, on the day appointed for the Election - &amp;amp; that 
&lt;/p&gt;
&lt;hr /&gt; 
&lt;p&gt;such officer, or officers - either themselves or their men by vote designate their Judge &amp;amp; Clerks of Election - &amp;amp; that the returns of Each regt - duly certified by the Commanding officer - be returned to you. the votes of Soldiers will Undoubtedly decide the Election.
&lt;/p&gt;&lt;p&gt;Please think of this - &amp;amp; if necessary either call the legislature together to grant permission - or Else - proclaim - for the people - on or before the 20th of Sept next. to dicide by their votes on that day - to say if their soldiers may vote or not.
