Provost Martial of this District. has by his arbitrary and tyranical conduct. rendered himself very unpopular and ought to be removed.  I know of but one man in this Co. who supports him, and that is Andrew Wardlaw our county enrolling officer.  I don't ask much for myself, yet would like not to be entirely forgotten.  but I can name a mutual friend who would fill the bill

Provost Martial of this District. has by his arbitrary and tyranical conduct. rendered himself very unpopular and ought to be removed.  I know of but one man in this Co. who supports him, and that is Andrew Wardlaw our county enrolling officer.  I don't ask much for myself, yet would like not to be entirely forgotten.  but I can name a mutual friend who would fill the bill

I was out of funds and employment, with a young wife to support, and you at once secured me lucrative employment, and in less than six months I was Asst Quartermaster General of Rhode Island, a position that I held one year, the pay being very small, Senator Anthony Spraque got me the appointment of Pay Clerk U. S. Army, which I now hold, stationed at his (?) place.

&lt;/p&gt;&lt;p&gt;Dear Govenur,
&lt;/p&gt;&lt;p&gt;I wrote you recently but since then Govenur Wells has returned from Washington and informs me that you will be there during the present month.
&lt;/p&gt;&lt;p&gt;I resigned my local agency of the Treasury Department on the 20th of Oct.  It was originally intended that I should have charge of a dist as &lt;u&gt;assist special agt&lt;/u&gt; and the duties in some respects were imposed upon me by Mr. Flanders, Supervising agt without allowing the pay or position besides I have been neglected by him while other officers of inferior qualifications were transfered and placed in charge of good dists.  In consequence of this and other just causes of complaint I resigned my charge of my dist &lt;u&gt;preferring to rely on my friends to have me commissioned directly by the Secretary of the Treasury and ordered to report to some other agency.&lt;/u&gt;  Mr. Flanders is not disposed to do me justice  I have been and am now favorable to the admission to Louisana under her free State Constitution and this in my
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;opinion explains his conduct toward me.  He seems in a great measure to be identified with rebel influences judging from his appointments.  For instance a Lawyer by the name of Horner raises a company and engages early in the rebel cause=serves as I am informed nearly three years.---gets starved out---returns to New Orleans---takes the oath of allegience and resumes the practice of law.
&lt;/p&gt;&lt;p&gt;He has been appointed by Mr. Flanders Examiner of Claims one of the most important positions, according to Mr F.'s idea of the laws that can be bestowed by the Sup agt. as all questions relating to the release of property under seizure are referred to this officer.  The truth is no Sup agent or other officers acting by his authority can release property under seizure without the sanction of the Secy of the Treasury.  Yet Mr. F has established an office of this kind---and has already released several millions worth of property---contrary to law.  He is decidedly the most incompetant officer that ever held an important position and nearly all his appointees are opposed to the administration and are well known Sympathizers with the rebellion.  You  need not wonder at the Louisana delegation urging his removal.
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;I think I deserve and am entitled to a Commission as &lt;u&gt;Assist Special Agent or agency for the purchase of products in some respectable dist.&lt;/u&gt;  I have written Gen. Logan a letter stating that I should rely on you and him to aid me in the matter.  I have made complete settlement with the Government.  The Auditor in the Custom House at New Orleans has declared to me repeatedly that my accts with the Government were well kept not surpassed by any agent in the Department.  I think there should be no doubt regarding my qualifications.
&lt;/p&gt;&lt;p&gt;I have labored faithfully for my friends in Illinois heretofore and must take the liberty to claim their influence in my behalf.  The whole Louisana delegation will unite with my friends and urge my appointment and &lt;u&gt;will do so in good faith.&lt;/u&gt;  I am poor with a family dependent yet I am young and hope to be able to reward those who assist me &lt;u&gt;when I most need it.&lt;/u&gt;
&lt;/p&gt;&lt;p&gt;The officers of Illinois regiments held a meeting a few days since at the St. Charles Hotel and unanimously recommended your election to the US Senate.  I attended and was highly delighted to see our army officers so unanimous in your behalf.
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;The army is not unmindful of their best friends.  I had an interview with Col Fouk and was perfectly surprised to hear of any opposition to you.  I thought it was perfectly understood that you should go to the Senate.  I know our people in southern Illinois voted with that understanding.  I see now---you are elected and I assure you the news of your election will raise a shout among Illinoisans throughout the army and this Country. &lt;/p&gt;&lt;p&gt;Dear Govenur,
&lt;/p&gt;&lt;p&gt;I wrote you recently but since then Govenur Wells has returned from Washington and informs me that you will be there during the present month.
&lt;/p&gt;&lt;p&gt;I resigned my local agency of the Treasury Department on the 20th of Oct.  It was originally intended that I should have charge of a dist as &lt;u&gt;assist special agt&lt;/u&gt; and the duties in some respects were imposed upon me by Mr. Flanders, Supervising agt without allowing the pay or position besides I have been neglected by him while other officers of inferior qualifications were transfered and placed in charge of good dists.  In consequence of this and other just causes of complaint I resigned my charge of my dist &lt;u&gt;preferring to rely on my friends to have me commissioned directly by the Secretary of the Treasury and ordered to report to some other agency.&lt;/u&gt;  Mr. Flanders is not disposed to do me justice  I have been and am now favorable to the admission to Louisana under her free State Constitution and this in my
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;opinion explains his conduct toward me.  He seems in a great measure to be identified with rebel influences judging from his appointments.  For instance a Lawyer by the name of Horner raises a company and engages early in the rebel cause=serves as I am informed nearly three years.---gets starved out---returns to New Orleans---takes the oath of allegience and resumes the practice of law.
&lt;/p&gt;&lt;p&gt;He has been appointed by Mr. Flanders Examiner of Claims one of the most important positions, according to Mr F.'s idea of the laws that can be bestowed by the Sup agt. as all questions relating to the release of property under seizure are referred to this officer.  The truth is no Sup agent or other officers acting by his authority can release property under seizure without the sanction of the Secy of the Treasury.  Yet Mr. F has established an office of this kind---and has already released several millions worth of property---contrary to law.  He is decidedly the most incompetant officer that ever held an important position and nearly all his appointees are opposed to the administration and are well known Sympathizers with the rebellion.  You  need not wonder at the Louisana delegation urging his removal.
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;I think I deserve and am entitled to a Commission as &lt;u&gt;Assist Special Agent or agency for the purchase of products in some respectable dist.&lt;/u&gt;  I have written Gen. Logan a letter stating that I should rely on you and him to aid me in the matter.  I have made complete settlement with the Government.  The Auditor in the Custom House at New Orleans has declared to me repeatedly that my accts with the Government were well kept not surpassed by any agent in the Department.  I think there should be no doubt regarding my qualifications.
&lt;/p&gt;&lt;p&gt;I have labored faithfully for my friends in Illinois heretofore and must take the liberty to claim their influence in my behalf.  The whole Louisana delegation will unite with my friends and urge my appointment and &lt;u&gt;will do so in good faith.&lt;/u&gt;  I am poor with a family dependent yet I am young and hope to be able to reward those who assist me &lt;u&gt;when I most need it.&lt;/u&gt;
&lt;/p&gt;&lt;p&gt;The officers of Illinois regiments held a meeting a few days since at the St. Charles Hotel and unanimously recommended your election to the US Senate.  I attended and was highly delighted to see our army officers so unanimous in your behalf.
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;The army is not unmindful of their best friends.  I had an interview with Col Fouk and was perfectly surprised to hear of any opposition to you.  I thought it was perfectly understood that you should go to the Senate.  I know our people in southern Illinois voted with that understanding.  I see now---you are elected and I assure you the news of your election will raise a shout among Illinoisans throughout the army and this Country.  I congratulate you upon your success over the conspirators against the Verdict of the people. accept my thanks for your many kindnesses and believe me

&lt;/p&gt;&lt;p&gt;Inclosed you will find the proceedings of a meeting of Illinois officers present in this City-- I recd your letter at Vicksburg, forwarded from Memphis.  I found it impossible to be at Springfield in time to do you any good.  I therefore accepted the &lt;u&gt;next best thing for your interests&lt;/u&gt;.  I found a large number of Illinois Soldiers here &amp;amp; soon found out their predelictions on the question of Senator.  I immediately called a meeting at the “St. Charles Hotel,” in my room of all Illinoisians interested in the matter.  I inclose you the result of their deliberations –&lt;u&gt; there was not a dissenting voice – all for Dick Yates, for United State Senator&lt;/u&gt;  Drunk or sober, whiskey or no whiskey – &lt;u&gt;all all for Dick Yates..  More brains! more Sincerity!! &lt;/u&gt; more &lt;u&gt;patriotism&lt;/u&gt;, when &lt;u&gt;drunk&lt;/u&gt; than all his oponents when &lt;u&gt;sober&lt;/u&gt;.  I speak plain – but I assure you, I

&lt;p&gt;am but stating the &lt;u&gt;facts &lt;/u&gt; – the army are &lt;u&gt;unanious&lt;/u&gt; for you &amp;amp; it will be a burning shame &amp;amp; a &lt;u&gt;fraud&lt;/u&gt; upon the army &amp;amp; upon everything that is &lt;u&gt;just, patriotic &amp;amp; right&lt;/u&gt; if you should be defeated.  I send you a hasty copy of the proceedings of the meeting in advance of the official copy.  See your friends in both branches of the Legislature &amp;amp; have them &lt;u&gt;postpone&lt;/u&gt; the caucus until the army can be heard from.  It will take several days to have the proceedings signed—but it will be done as soon as posible &amp;amp; forwarded.  I send this in advance to notify your friends, that the soldiers &lt;u&gt;wish to be heard&lt;/u&gt; on this matter &amp;amp; they &lt;u&gt;swear eternal vengeance&lt;/u&gt; on any man or &lt;u&gt;set&lt;/u&gt; of &lt;u&gt;men&lt;/u&gt; who take &lt;u&gt;advantage&lt;/u&gt; of their absence &amp;amp; their openly expressed views. &lt;/p&gt;&lt;p&gt;In doing so I cant help remembering what I said in reply to your letter written after your first defeat by Harris for Congress, your desire to quit Politics and the law and engage in business was the feeling expressed by you at the time. You will remember I told you in reply, that from habit education and talent your services would be required in other ways - (How would you like to engage in some trading opperation?)
&lt;/p&gt;&lt;p&gt;You have found it so and while I have been so situated as not to be able to render much personal service in your advancement
nevertheless I have felt and noticed its progress with the same interest as though I had been a personal participant in the fights.

"I have it here Bushnell in black and white." This affiant does not now remember what reply this affiant made to said remark, but very soon after, the said person presented a slip of paper upon which as near as this affiant can now recollect, were the following words and figures to wit "$5000 in addition, if you do what we think you can"; that the reply of this affiant was, as near as this affiant can now remember, "It is in vain. my mind is unalterably fixed" This

B. Washburn on diferent times upon the question of United States Senator, that one of said persons asked me, "What do you want Bushnell. help us &amp;amp; we will help you"  My reply was "I have pledged my Support to Rich Yates upon this question, and Shall never retract it." that a paper was Exhibited by the other person purporting to be a release of Perkins Bass and Rob J Fergersol to any place which I might desire, and the remark made, "I have it here Bushnell in Black and White." This affiant does not now remember what reply this affiant made to Said remark, but very Soon after, the said person presented

&lt;p&gt;a Slip of paper upon which as near as this affiant can now recolect were the following words &amp;amp; figures to wit. &lt;/p&gt;&lt;p&gt;As the case now stands, the sentence passed by the court cannot legally be carried into execution by the Department Commander, for the reason that a portion of the findings of guilty by the Court and which must reasonably be supposed to have had their influence upon the minds of the Court, in making up the sentence passed, have been disapproved by the officer ordering the Court, while the sentence is approved.
&lt;/p&gt;&lt;p&gt;It is by no means certain that the sentence as passed is, as it would have been, had the accused been found not guilty, of the 3rd Specification of 3rd charge and 6th charge and its specifications. Hence the impropriety of disapproving the findings and at the same time approving of the Sentence passed as the deliberate judgment of the Court upon those findings.
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;Aside from this, a careful examination of the proceedings seems to one clearly to indicate more of desire on the part of the Lieutenants who appear as prosecuting witnesses to advance their own interests that those of the Government by the removal of the accused, who appears to have managed his Company affairs, with as much or more ability, and as great regard, for the interests of the service, as the vast majority of officers in the army.
&lt;/p&gt;&lt;p&gt;While hardly a specification in all the long list of charges, has, to my mind, been clearly proved, the evidence nevertheless shows the accused to have been guilty of some irregularities that probably deserve censure, but nothing that would warrant the carrying into execution of the sentence passed.
&lt;/p&gt;&lt;p&gt;The accumulation of charges is probably one of the worst features in the case. This is, and always has been considered detrimental to the interests of the public service and good of the army.
&lt;/p&gt;&lt;p&gt;I have therefore to recommend that the proceedings be disapproved and the accused restored to his command, believing as I do the present trial, will be a sufficient warning to the accused to avoid even the appearance of wrong doing, and the disapproval of these proceedings, restore to the Army an Officer who
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;has proved himself a gallant one on many a hard-fought field.

&lt;/p&gt;&lt;p&gt;I was so rejoiced at our triumph in your successful candidacy for the Senatorship, that I almost forgot the clouds which have again gathers around my own hearth-stone.
&lt;/p&gt;&lt;p&gt;I have begged Mr Bushnell to hand you this, and to ask your yet further protection for me and mine.  Some enemy has finally prevailed against us, and Gen Schofield has resorted to the unusual step of reversing the Decision of his own Judge Advocate Genl whose decisions at Washington, I have been told by persons officially informed, are considered and highly respected, as those of a talented and conscientious officer.  I enclose his Decision, to Mr Bushnell, who will show it to you.
&lt;/p&gt;&lt;p&gt;My husband is so amazed and indignant that he leaves all action to me.  I shall appeal to the President.  I beg your help.  O Gov Yates! - you have been a friend to me through all this sore trial - and now, in the hour of your hightest and most deserved triumph, I feel sure you will not forget me when I cry to you, as I do, from the depths of an aginized heart.  I ask you to write to the President asking his interposition, and to forward the letter to me.  Judge Norton will present them and be my advocate.  And I beg, I entreat you to &lt;u&gt;care&lt;/u&gt; for my distress, and to do anything else not suggested by me.

Captis Curtiss himself informs me of these facts, and writes to prepare me for the worst he being a friend of my husband's.  There has been a fraud somewhere.
&lt;/p&gt;&lt;p&gt;And I beg, I entreat you to have any new Commissions for the Lieutenants of the Battery prevented, until we have time to hear from the President.

&lt;/p&gt;&lt;p&gt;I was so rejoiced at our triumph in your successful candidacy for the Senatorship, that I almost forgot the clouds which have again gathers around my own hearth-stone.
&lt;/p&gt;&lt;p&gt;I have begged Mr Bushnell to hand you this, and to ask your yet further protection for me and mine.  Some enemy has finally prevailed against us, and Gen Schofield has resorted to the unusual step of reversing the Decision of his own Judge Advocate Genl whose decisions at Washington, I have been told by persons officially informed, are considered and highly respected, as those of a talented and conscientious officer.  I enclose his Decision, to Mr Bushnell, who will show it to you.
&lt;/p&gt;&lt;p&gt;My husband is so amazed and indignant that he leaves all action to me.  I shall appeal to the President.  I beg your help.  O Gov Yates! - you have been a friend to me through all this sore trial - and now, in the hour of your hightest and most deserved triumph, I feel sure you will not forget me when I cry to you, as I do, from the depths of an aginized heart.  I ask you to write to the President asking his interposition, and to forward the letter to me.  Judge Norton will present them and be my advocate.  And I beg, I entreat you to &lt;u&gt;care&lt;/u&gt; for my distress, and to do anything else not suggested by me.

May I beg you to examine it closely, and to remember that although it was as you will see addressed to Capt Curtis, it never reached him until he found it by accident in the office of some official - and when it did come to him, which was only five days ago, it came in the form of an order made out - signed by Gen Schofield - and adverse to us.  Captis Curtiss himself informs me of these facts, and writes to prepare me for the worst he being a friend of my husband's.  There has been a fraud somewhere.
&lt;/p&gt;&lt;p&gt;And I beg, I entreat you to have any new Commissions for the Lieutenants of the Battery prevented, until we have time to hear from the President.
&lt;/p&gt;&lt;p&gt;Please notice that Maj Burnett says the sentence of the Court cannon &lt;u&gt;legally&lt;/u&gt; be carried out.  How &lt;u&gt;can&lt;/u&gt; it then be done?
