&lt;/p&gt;&lt;p&gt;There are a great many Negroes here who dare not stay for fear of being kidnapped, We cant protect them, they would make good soldiers and would then be beyond the reach of Copperhead Malignity and would be of use to the country.  They are

&lt;p&gt;carrying off Negroes from here at night on [speculation?] &amp;amp; putting  them in jail in Palmyra  Mo &amp;amp; other places, as I am informed.  Why should not these men be made soldiers of. Nearly 1/3 of Gov. Andrews Mass. Regt so called was raised here out of our refugees.

&lt;/p&gt;&lt;p&gt;The well known case of Marbury vs Madison 1 branch 137 in 1 Condensed Reports U.S. Supreme Court pages 276 279, 280 decided Feb. term 1803 settled the law under the Constitution of the United States that a mandamus would not be against the Executive branch of the National Government, nor even against a Secretary of State of the United States, the appointee and one of the advisers of the President, where the Secretary's acts were “political” and within the scope of executive functions and were not strictly ministerial.  The same rule clearly
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;applies so far as the Executive branch of the Government of Illinois is concerned 
&lt;/p&gt;&lt;p&gt;The Governor as the Executive is not subject to mandamus from the Courts.
&lt;/p&gt;&lt;p&gt;The Lieut. Governor occupies a double relation to the State both Executive (at times) and Legislative when Presiding over the senate. He is not subject to a Mandamus in either capacity.
&lt;/p&gt;&lt;p&gt;The case of The People ex re Billings vs Bissell Governor 19 Illinois, 229 to 234 decides with much ability that the court has no power to compel the action of co-ordinate brances of Government though it is said that as in the case The People ex re vs Matteson 17 Ills. 167 the excutive might make an agreed case and submit it to Supreme Court, but that the
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;court claims no right to exercise coercive jurisdiction over the executive.
&lt;/p&gt;&lt;p&gt;My opinion is that it is not the duty of Governor Yates nor of Lt Governor Hoffman to appear voluntarily on notice such as has been served.
&lt;/p&gt;&lt;p&gt;Should the court improvidently issue an alternative writ of mandamus, answer should be made merely however as a matter of respect to the court that the court had no power over either the Governor or Lieut. Governor by compulsory writ.

&lt;/p&gt;&lt;p&gt;Gentlemen:  This will be handed you by Major Robert W. McClaughry 118th Regt Ills. Vols. Infantry  I wish to ask you your cordial recommendation of what he wishes.  Major McC. in 1862 was the editor of a Douglas Democratic paper in Hancock Co.  He aided the government in raising men for Regt after Regt.  and finally abandoned his business and raised a company for 188th.  He has in

&lt;hr /&gt;
&lt;p&gt;curred the ill will of many of his old political friends. He is a man of fine attainments in business, honest, and trustworthy and has been a brave soldier in the field.  He has to some extent [injoined?] his health so as to render it hard for him to do field duty, tho he intends to try it.  He wishes however a transfer from the line into the Pay Department, and he possesses both integrity &amp;amp; capacity to fill the position of Asst Paymaster of Vols.  Will you be

&lt;p&gt;kind enough to join me in a recommendation that Major McClaughry be transferred to the pay department.  I know that he prefers service in the line but I doubt whether he can do the duties of Major in the field for a great length of time

&lt;/p&gt;&lt;p&gt;Governor:  I have just seen dispatch of 14' inst. from War Dept. that our Negro Battalion has to go to Annapolis, that those who had raised them and wished commission might accompany the negroes to Annapolis &amp;amp; if they passed Gen. Caseys board they would be commissioned if not, others (Eastern men of course) would be appointed.  This treatment is outrageous,  Gov if these men were raised by those that I have with concurrence of Col Bross asked to be commissioned raised with the money of my friends &amp;amp; my own.  If the battalion goes to Annapolis it will be a negro [illegible] with a Lt. Col. And one 2' Lieut. (who never raised a man but has Commissioned after passing Caseys board)  You have a list furnished you by Mr. Hatch &amp;amp; agreed to by Col Bross insist that department shall permit you to select &amp;amp; they issue commissions to those selected by you or keep the men where they are

&lt;/p&gt;&lt;p&gt;Dear Sir:  On behalf of Private John Henry Finlay Company L. 2 Illinois Volunteer Cavalry now in 15 ward U. States General Hospital Baton Rouge Louisiana I wish you to request his immediate transfer to General Hospital Quincy Illinois.  Dr. [Brinton?] Surgeon in Charge here says it will be done at your request.  Private Finlay's father lives in Hancock Co.  His Uncle M. F. Finlay of this place is very anxious he should be sent here.  He was wounded in the arm in Baton Rouge last spring has been a long time in Hospital.  We may save his life by the transfer.  Your early attention will greatly oblige me &amp;amp; our good friend M. B. Finlay

States General Hospital Baton Rouge Louisiana I wish you to request his immediate transfer to General Hospital Quincy Illinois.  Dr. [Brinton?] Surgeon in Charge here says it will be done at your request.  Private Finlay's father lives in Hancock Co.  His Uncle M. F. Finlay of this place is very anxious he should be sent here.  He was wounded in the arm in Baton Rouge last spring has been a long time in Hospital.  We may save his life by the transfer.                   <text>&lt;p&gt;The first classes at the McCormick Theological Seminary took place in a log cabin in Indiana in 1829. During the Civil War the school relocated to Chicago's Lincoln Park neighborhood. In 1859 Chicago entrepreneur and Presbyterian layman Cyrus H. McCormick and his wife, Nettie Fowler McCormick, became the seminary's major financial patrons. The relationship between the McCormick family and the school remained well into the twentieth century.&amp;nbsp;Shortly after McCormick&amp;rsquo;s death in 1884, the school was renamed McCormick Theological Seminary. Several campus buildings are named for McCormick family members including McCormick Hall, Fowler Hall, and Virginia Library. &lt;br /&gt;&lt;br /&gt;After Dr. Martin Luther King, Jr.'s assassination in 1968, seminary faculty and students were active in the civil rights movement and provided assistance to displaced and injured participants. The seminary relocated to Chicago's Hyde Park neighborhood in 1975.&lt;br /&gt;&lt;br /&gt;The photographs in this collection include portraits of the McCormick Theological Seminary Class of 1896, school professors, and campus buildings.&lt;/p&gt;</text>
