&lt;/p&gt;&lt;p&gt;In explanation I would say that I was employed by a Good Union House here to haul a load of Butter from here to a Point on the Ohio River opposite Smithland Ky. I did not think I was doing anything wrong - they told me the Butter was Sold to parties there &amp;amp; as I knew them to be truthful men &amp;amp; as Ky was a Loyal State &amp;amp; c - 
&lt;/p&gt;&lt;p&gt;On the arrival of my teams at Du Quoin my large teams attracted great attention &amp;amp; Suspicion -
&lt;/p&gt;

&lt;p&gt;they stopped them &amp;amp; telegraphed to Genl Fremont that they had detained a train of teams (only two) loaded with Butter &amp;amp; ammunition of War &amp;amp;c. he in reply said = detain Property till further orders meaning of course said suspicious property &amp;amp; not the teams - I &amp;amp; owner of Butter went over to see about it &amp;amp; were arrested &amp;amp; sent to Col Oglesby who remanded us &amp;amp; our Case to Genl Fremont who referred our case to Maj McKinstry, he investigated the case &amp;amp; at once reported in our favor &amp;amp; ordered us released also Property, the necessary papers were there made out &amp;amp; sent by us to Genl Fremont to be signed - his private Secretary told us that it could not be done that Saturday 24th Evng as the Genl was so busy, but that I might with certainty go on to Duquoin and the dispatch would be there in time for me, I went there but the Dispatch had not been recd. I was then told by

&lt;p&gt;Mr I. H. Brown (who is a very worthless fellow &amp;amp; refer you to Mr. D. S. Phelps for Proof) that he had orders to hold the property till further orders from you - I telegraphed to you as I did thinking that Genl Fremonts order would come as promised - I being tired waiting there came here to see what was the matter &amp;amp; find the Genl has been so busy &amp;amp; has lost some time with Burial of Genl Logan that the papers have laid over, but have the promise of his Secretary that he will try &amp;amp; have it attended to to day -

&lt;/p&gt;&lt;p&gt;I am under the impression that Gov. Yates is at Washington and write to you though I wish very much that what I say may be laid before him
&lt;/p&gt;&lt;p&gt;Our regiments must be filled, Launch extraordinary efforts be used for doing so at once.
&lt;/p&gt;&lt;p&gt;We are to-day inferior to the rebels in Tennessee-- Their merciless conscription has filled their regiments and all the able-bodied men in the South are now soldiers, and I predict that within less than sixty days Kentucky will be invaded unless more than common efforts are made we will be pushed back to the Ohio. -- or the whole rebel force West will unite against Grant and crush him.
&lt;/p&gt;&lt;p&gt;You must Arrest and send back deserter - Our new regiments are gone up – I send you a statement showing condition of 110th Ills. which is the worst of 
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;all - but all are bad enough.  Don't delay this.  Do it if it costs the lives of enough of them to terrify the Copperheads into submission.  
&lt;/p&gt;&lt;p&gt;We are on the eve of the great struggle of the war and you must all work as if the issues were in your hands.
&lt;/p&gt;&lt;p&gt;The late developements prove that the rebels are not only driving into the ranks all men between the ages of 18 and 55. but arming the negroes and you need not be surprised when I tell you that the inducements offered them being the same – they prefer the rebel service to ours.
&lt;/p&gt;&lt;p&gt;The rebels offer them freedom and the hope of remaining at their present homes. - and mark the prediction - these men we have quarrelled over to the point of civil war. will to a great extent, be found in arms against us.
&lt;/p&gt;&lt;p&gt;Don't fail to warn Governor Yates, that a day now, is worth weeks after the 1st of July.

&lt;/p&gt;&lt;p&gt;I am sorry to write that correspondence to your office and this – indicates the presence of an alarming number of deserters from our regiments in the field - which the Government should arrest and return or supply you promptly with means and force to do.  At present order of the War Dept direct that absentees may report to Col. Morrison Superintendent of Recruiting service - but we have too long felt his utter indisposition or incompetency to accomplish practicable results under any orders he may have to execute.

&lt;/p&gt;&lt;p&gt;I am under the impression that Gov. Yates is at Washington and write to you though I wish very much that what I say may be laid before him
&lt;/p&gt;&lt;p&gt;Our regiments must be filled, Launch extraordinary efforts be used for doing so at once.
&lt;/p&gt;&lt;p&gt;We are to-day inferior to the rebels in Tennessee-- Their merciless conscription has filled their regiments and all the able-bodied men in the South are now soldiers, and I predict that within less than sixty days Kentucky will be invaded unless more than common efforts are made we will be pushed back to the Ohio. -- or the whole rebel force West will unite against Grant and crush him.
&lt;/p&gt;&lt;p&gt;You must Arrest and send back deserter - Our new regiments are gone up – I send you a statement showing condition of 110th Ills. which is the worst of 
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;all - but all are bad enough.  Don't delay this.  Do it if it costs the lives of enough of them to terrify the Copperheads into submission.  
&lt;/p&gt;&lt;p&gt;We are on the eve of the great struggle of the war and you must all work as if the issues were in your hands.
&lt;/p&gt;&lt;p&gt;The late developements prove that the rebels are not only driving into the ranks all men between the ages of 18 and 55. but arming the negroes and you need not be surprised when I tell you that the inducements offered them being the same – they prefer the rebel service to ours.
&lt;/p&gt;&lt;p&gt;The rebels offer them freedom and the hope of remaining at their present homes. - and mark the prediction - these men we have quarrelled over to the point of civil war. will to a great extent, be found in arms against us.
&lt;/p&gt;&lt;p&gt;Don't fail to warn Governor Yates, that a day now, is worth weeks after the 1st of July.

&lt;/p&gt;&lt;p&gt;I am sorry to write that correspondence to your office and this – indicates the presence of an alarming number of deserters from our regiments in the field - which the Government should arrest and return or supply you promptly with means and force to do.  At present order of the War Dept direct that absentees may report to Col. Morrison Superintendent of Recruiting service - but we have too long felt his utter indisposition or incompetency to accomplish practicable results under any orders he may have to execute.

&lt;/p&gt;&lt;p&gt;I wrote to you in November and asked you the real meaning of the elections in one State and hoped to get your impression formed on the ground and in that way get rid of my apprehensions or have them confirmed and if confirmed take steps as far practicable to avert evil
&lt;/p&gt;&lt;p&gt;My belief is that we are to have troubles north of the Ohio.  What is yours?  If the signs force that conclusion what are we to do are we to wait until all the arrangements of the conspirators are perfect and then calmly submit to the triumph of Jeff Davis's Allies or shall we prepare for the emergency and crush them out   You are on the ground and might be more informed upon the principal questions
&lt;/p&gt;&lt;p&gt;Assuming the reality of the [illegible] or suspected plans of the revolutionists might not the Governor
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;have a military force under his control to meet emergencies,  If that shall be thought necessary I think there can be no difficulty in organizing such a force and that too in such manner as will be free from difficulty
&lt;/p&gt;&lt;p&gt;There are today in Illinois from ten to twenty thousand able bodied me absent from their regiments   Three fourths of these men may be gathered at Springfield or at any other place or places in the state and made a vigorous decided commando kept and drilled as long as there is danger  This force may be sufficient for all [illegible] purposes and I think you ought have it
&lt;/p&gt;&lt;p&gt;I should regret to see the loyal men of Illinois exhibiting too much eagerness to appeal to arms but I hope never to see another revolution ripen on this country under the eyes of a timid government until it almost succeeds without the forms of resistance.
&lt;/p&gt;&lt;p&gt;If there is danger of trouble upon an [introduction?] from the Governor I will myself come to Springfield and assist in preparing to meet it  Let us be cautious
&lt;/p&gt;&lt;p&gt;Do no act subversive or orders but let no Childish apprehensions prevent the loyal men of Illinois from taking prompt steps to ferret out and crush the plans of traitors,   If the Governor should invite me to Springfield to confer "in reference to the interests of Ills troops in the field” I will obtain leave of 
&lt;/p&gt;

&lt;p&gt;absence at once
&lt;/p&gt;&lt;p&gt;It must be understood that my sources of information are not very satisfactory and I am prepared to hear any will gladly hear that there is not danger.  Still you at home may as one make up your minds today as you will be compelled to do here after that there is a type of Democracy in all the Northern states which is in strict alliance with Richmond  Whether its part in the programme of revolution includes physical resistance to the government or not or whether its whole but infamous part is to excite faction stimulate divisions and by these and other infamous means embarass the government I am not prepared to say.  They may intend violence  Let them be watched and let the government be prepared with a force on hand to meet and crush them.  
&lt;/p&gt;&lt;p&gt;Dont wait until they succeed in involving their innocent followers in crime Dont let us perish from imbecility.

&lt;/p&gt;&lt;p&gt;On the 5th of July we left Camp Wood for Canton Mo, took Jim Green and let him go again, though some of our friends think he ought to have been hung.  Indeed if I had been allowed to stay there and protect the Union men or had had the means of arming them for their own protection I would have sent him to St. Louis for trial as I could neither protect or arm the Union men I yielded to their advice and let him go. I am still satisfied that I was right.  From Canton we moved to Monroe Mo for the relief of Col. Smith, and from thence after marches and counter marches to Sturgeon Mo and that I may literally realize the full blessing afar, 
&lt;/p&gt;
&lt;hr /&gt;itinerant life I remove my Head Quarters ten miles tomorrow to Renick having been charged today with the management of about Forty miles of Rail Road and watching large numbers of Secessionistes.
&lt;p&gt;I write to your however with reference to my interests in the welfare of my regiment.
&lt;/p&gt;&lt;p&gt;The Medical Board rejected D. Stevenson though judging him by the ordinary and what has always to me seemed the most satisfactory rule, – success and good character he ought not be rejected.  I am exceedingly sorry, that he failed, to secure the approval of the Board but allow me now to ask, that if the D. cannot be appointed, that no appointment for my regiment be made until I come to Springfield, which will be about the 1st of August

&lt;/p&gt;&lt;p&gt;Unofficially you no doubt would like to keep advised of the state of things in Missouri and my regiment and indeed all the regiments regard themselves as Illinoisans, though in the Federal Service and look to you as their natural leader  You would be astonished at the extent of this feeling  If these military operations had not progressed and my advice was asked I would insist that as Governor of Illinois you take the person of command of all our troops in the field indeed I am not sure but you ought to demand it now such a course would [illegible] the protection of our men from the effects of the Squabbles and jealousies of Small minded men the regular army or from other States to which at present we are Sacrificed and the state of affairs here illustrates  For illustration There are at Rolla now three armies under three independent commanders and [illegible] Small where [united?] are Scattered over some five miles of counties exposed to destruction from an enterprising enemy of even half their aggregate strength  Wyman (Ills 13th) and Stevenson (Mo 7th) occupy a ridge east of Rolla less than half mile Ills 14th and 15th are encamped two and a half or three miles SW of Rolla together on a ridge near an abundance of Wood and Water about a mile   Still further west Maj [Stinges?] with the Artillery the remains of the Kansas 1st &amp;amp; 2nd and some regulars is encamped while South west something more than a mile Sigel with a few hundred men encamps-- Wyman commands the three regiments and the 7 Mo and claims the chief command – and is entitled to it

&lt;hr /&gt;Stinges who has been drunk on all the three or four occasions when I have met him refuses to be commanded and Spends most of his time cursing Sigel who has gone to St Louis   If some commander was present who could and would take charge of these discordant elements some useful results might be expected but [Ben McCalleyn?] will command us if he chooses to come upon us quietly and demand for we can render but little support to each other-- Gen Pope might have met this demand as an Illinois man and there is so much complaint of his bad temper and arbitrary conduct it may be doubted now if he can do Still he is the best man all concede for [illegible] among the men who had and I should personally be satisfied with him But Illinois ought have a Maj Genl and who can demand it so properly as the Governor who can and has raised 50,000 men and who could thus represent his state politically and in the field with a commanding influence  If this not worth attention
&lt;p&gt;The Battle of Springfield was a terrible affair  Our loss was a full thousand killed and wounded and the rebel loss at least three thousand,  The rebels are now massing in the direction of Jefferson leaving a heavy force at Springfield or in that vicinity though they will not be able to maintain their forces there very long.  They have desolated the country all around Springfield and will consume everything in the west the poor people there must suffer this winter unless which is possible The South [west?] Mo. is deserted
&lt;/p&gt;&lt;p&gt;We get no news here from Illinois except he Meager Scraps found in the Mo Democrat Who are the New Colonel, and who the Brigadier General we know nothing I suppose the regular army is to furnish all the officers for positions they will accept

&lt;/p&gt;&lt;p&gt;Within the last few days Col Turner who was mustered into service one day before me claims Seniority on that ground.  My impression is and was that you ranked us and mustered our regiments and that this was and is conclusive
&lt;/p&gt;&lt;p&gt;According to the order of the War Department of 26th Aug 1861 which is [illegible] to be applied was Turner would be the Senior Col of the State and myself and Wyman who were mustered on the same day would have to draw lots for the Second place  The question is important now for upon it depends whether Col Turner or myself shall command a Brigade
&lt;/p&gt;&lt;p&gt;Be good enough to inform me what is the real state of this question and if this order of the 26 Aug prevails it overrules your action and makes Cook Oglesby &amp;amp;c junior to many of us  Our regiment is in fine health and we are ready for work

&lt;/p&gt;&lt;p&gt;Every day Satisfies me more and more that unless you take hold of the questions that relate to and intimately concern the honor and even the lives of our troops the lives of half and the labors of all will be thrown away  Just now we have a practical illustration of this.  Several Illinois regiments and others amounting to above Eighteen thousand are put into Winter quarters here   This is bad enough and sufficiently –  illustrates the utter imbecility and folly of the whole system upon which the affairs of this Department are managed for if troops are needed here at all five thousand federal troops are more than sufficient
&lt;/p&gt;&lt;p&gt;But this is not the worst of this  The first Division (ours) which includes the 14th 15 &amp;amp; 42 Ills two Indiana and one Missouri regiment are now ordered to prepare Winter quarters in a swamp a large part of which is under Water and I cannot march my men to it instead wading and when we drain it, we have to suffer from the malacious influence of large tracts of fresh drained swampland and when I lead my poor men into these quarters I shall bury many of them before spring and I say to you that no man of good sense or 
&lt;/p&gt;
&lt;hr /&gt; common humanity would require of us to go there And there is no volunteer Officer in the service that is stupid enough to do it  Now with the prospect of having men die by Scores from the folly of this Indiana Colonel who comes from the Regular Army what shall I do
&lt;p&gt;In my opinion you  [ought?] at once send an intelligent agent who has both sense and courage to visit  these Illinois regiments before this needless but shameful sacrifice take place and then do what becomes the Chief Magistrate of a State which furnishes 80000 men to do   If you do not feel at liberty to do this or something else effectual you ought in justice warn the people against entering a service so desperately managed
&lt;/p&gt;&lt;p&gt;Again more than ten days ago your Quarter Master packed and sent forward clothing for my regiment and indeed complete equipments and from the [unwillingness?] of the Officers at St Louis (as I believe that you should furnish us not one of these things have come to hand though many of my men are going about day after day in drawers alone not having a single pair of Pantaloons

&lt;/p&gt;&lt;p&gt;If the plan suggested to Genl Buell fails suppose you apply to Genl Halleck to [illegible] a Brigade to formed of your Camp Butler forces and other regts in Camp in the state say the Mo regts at Jonesboro and my fourteenth or the regts in Camp alone and  assign me to the command I will then return at once organize arms and [illegible] with the [illegible] in good style 
&lt;/p&gt;&lt;p&gt;In short if I can render any aid in organizing the men in Camps I will cheerfully do so  Please let me hear from your [tonight?]

Lieut Augustus Hoyer of the Artillery Company of the 14 Regiment Ills was commended his excellency the Governor of the State of Illinois and has from the time of receiving his commission acting as Aid de Camp for me
&lt;/p&gt;&lt;p&gt;Lieut Hoyer has discharged all his duties with industry and fidelity and to my entire satisfaction and I should greatly regret the loss of his services.
&lt;/p&gt;&lt;p&gt;I hope in the reorganization of the Artillery Company he may be recommissioned and I earnestly recommend him for a Lieutenancy in that or any other regiment or company of Illinois troops  in which a vacancy may be formed
&lt;/p&gt;&lt;p&gt;I have the Honor to be

&lt;/p&gt;&lt;p&gt;You are aware that almost all of our regiments are greatly reduced in numbers some of them so much so that it is mockery to call them regiments and cruel to impose upon them the duties of regiments
&lt;/p&gt;&lt;p&gt;How is this evil to be cured is the question   If your determination reported in the army is adhered to it will be a commencement  We understand here that it is your intention to direct all the men to be raised in future in Ills to your first sixty (60) regiments
&lt;/p&gt;&lt;p&gt;This is a wise determination  One which will continue the regiments beyond the term of the present enlistments but it will be only a partial remedy Within less than a year from this time the officers and men of nearly sixty of our first regiments will go out of service and if all future 
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;enlistments accrue to their benefit they will still be small and your regiments which receive no recruits will lose all spirit when they learn that they are never to be filled up
&lt;/p&gt;&lt;p&gt;Suppose then that you adhere to the resolution before spoken of to assign all the men hereafter raised to one regiment numbering from 7 to 66 inclusive and that you determine to keep them full or nearly so, or in other words determine to keep 60,000 men in the field from Illinois during the war.
&lt;/p&gt;&lt;p&gt;To do this use all recruits in the manner before spoken of
&lt;/p&gt;&lt;p&gt;Allow any regiment between 7 and 66 to unite whenever they can make a satisfactory arrangement with any regiment of a higher number the consolidated regiment to take the number of the lowest one  For example the 22nd and 110th regts are eager to be consolidated and to be called 22nd   Together they have the requisite number of Field Officers and together have barely 500 men for duty 
&lt;/p&gt;&lt;p&gt;The 21st has I believe one Field Officer the 73rd has perhaps two with not over two hundred men  I think if it was permitted I could arrange for the consolidation under this plan of nearly all the regiments in this army and by doing so vast expenses would be avoided and thus efficiency greatly
&lt;/p&gt;

&lt;p&gt;increased  Of course the “States Rights” doctrine being now at a discount the consent of the War Department would be necessary to this but I presume that consent could be procured by you if the plan meets your approval

To His Excellency Richard Yates Governor of Illinois Dear Sir.  I had the honor to receive your telegram of Saturday (though not until late last night), and also that of today, tendering me the colonelcy of a Regiment of Illinois Volunteers.  I replied by telegraph that I could not accept though I regretted it very much.  It would be improper for me to dismiss so flattering an offer from your Excellency without explaining my reason for so doing.  The regiment to which I have belonged since the beginning of this war is being converted into a light-artillery regiment.  The work we have undertaken is a very great one, and will demand the united efforts of all engaged in it.   Therefore, although my position in the regiment is a subordinate one, I do not feel at liberty to abandon
