I am constrained, as a soldier of the

State of Illinois; to appeal to you for an investigation of my

case, as I am falsely accused of the Charges, that were preferr

the Court Martial, as far as was observant to me; also the Evedence

on both sides, impartially.

I was arrested in the morning of the 26th February, 1864

at which time I was brought before the Provost Marshall

the woman being present, who accused me (Mrs Mary J Fry,

alias, Margret Fry) who made affidavit, to this effect; that

I went to her house the night of the 20th of Feby and, threatened

to break down her door, if she did not open it; that she opened

the door; and that I took her by the throat, and threw her

on the bed, and that she kicked, and got away from me,

and that I then went off saying, that she would suffer for

not complying with my wishes; and that if I was not the

man, that came there, I resembled him very much; but

that she was not sure, whether I was the man, or not.

After this examination at the Provost's Office I was reta

ken back to the Guard House, where I remained without

knowing anything in regard to the issue of the above,

untill the 15th of March when I recieved a Copy of Charges,

that we could not get to Mrs Fry's house, the river being so high

Did not know of Mrs Fry having a character, but knew that

if a man asked her to sit down; she would lay down; (here

the President of the Court, objected to her character being provin)

I (Hynd) have seen the accused (Pierce) several times; and I have

never heard him utter a word, or even make an action unbecoming

a soldier, and a gentleman.

The next two witnesses were Perry Atchlie, and his wife; whom

swore, that I came to his (Atchlie's) house, on the night of the 20th

of Feb (or at least the night it is alledged by Mrs Fry that he

(accused) was at hers,) at five or six hours before daylight, and staid

Crofs examined, was sure I was absent on that night from

camp; there was no roll call for three months - Did not know

Absent, and, some one that seen me leave Camp told him.

That my name was not all the roll book, being on detached

duty, as Corporal of the Regimental color guard.

Before I was tried, I had gave a list of witnefses

to the Judge Advocate, which he never furnished on trial

He also objected to me having the Major of my Regt; for

being my counsel. I asked the President of the court, if he

called this a court of justice he answered in the negative, that

it was a court of example. I empeached Mrs Fry's Evedence

on the grounds of her being a prostitute, but it was rejected

as also were my witnefses, from giving her character in full.

I was never at Mrs Fry's house, nor never knew her by

name, untill I seen her at the Provost Marshal's Office

I donot deny being away from camp on the night of

the 20th of Feb; but I deny being from camp without

leave, I being away from the company; and having a general

pafs at will untill further orders signed by the Col of the

Reg't, and I presented my pafs & detail on trial, but

the court did not reply to it.

On the 26th of April an Order came to me, from Brig Gen'l

Osterhouse to be released, and returned to my Regt, my

trial being over fourteen days. I reported to my Regt;

which was distant thirty six miles from the Guard House,

I was rearrested again, and sent back to Huntsville

from thence here.

I refer you to any of the Officers of my Regt, for my

conduct as a soldier; I have never been under arrest prior

to this; but have always done my duty faithfully, and

to the best of my ability, and shall always endeavor to do the

same if I am premitted the opportunity. Trusting your

Excellency will give my case your earnest consideration,

I am constrained, as a soldier of the

being my counsel.

I donot deny being away from camp on the night of

the 20th of Feb; but I deny being from camp without

pafs at will untill further orders signed by the Col of the

Reg't, and I presented my pafs & detail on trial, but

the court did not reply to it.

On the 26th of April an Order came to me, from Brig Gen'l

Osterhouse to be released, and returned to my Regt, my

trial being over fourteen days. I reported to my Regt;

which was distant thirty six miles from the Guard House,

I was rearrested again, and sent back to Huntsville

from thence here.

I refer you to any of the Officers of my Regt, for my

conduct as a soldier; I have never been under arrest prior

to this; but have always done my duty faithfully, and

to the best of my ability, and shall always endeavor to do the

same if I am premitted the opportunity. Trusting your

Excellency will give my case your earnest consideration,

Her son Rowland is a youth of much more than ordinary ability, and of devoted loyalty and patriotism.

For five days he shared the fortunes of the fight, and took his chances for wounds, and death, at Murfreesboro, where a majority of his companions dishonored their Regiment, by stacking their arms, and refusing to appear upon the field.

He is a gallant young man, and

does not wish longer to remain connected with that Regiment.

Honorable sir
Knowing the interest you always have taken
in the welfare of the Union Soldiers, and
especially them from Illinois. I take the liberty of
writing this letter, hoping that you will not be offended
And that I may not ask your assistance in vain
As I well know that only one word from you, will
set me alright, without any loss to the governement
Please have patience enough to read the following
I enlisted in the same Battery G. 2d. Ills Art. the 6th of august 1861
And reenlisted in the same Battery about new years
1864. And during the whole time of my service to
the present time have always done my duty
And been along with the battery in every engage
ment and Campaign it has gone through since it
first was organized. But of late my health has been
very poor. so the long marches and hardships we

Now have to go through comes very hard upon
me. And as I do not want to report myself sick
or unfit for duty. I suffer a great deal. Others
under the same circumstances or for less cause would
either go to some Hospital or be transferred to the invalid
Corps but as I do not wish to do either, I would humbly
ask your honor to have me transferred to some
Seagoing man of war. For I think that if i got on
salt water again I would regain my usual strenght
which I had before I come in the army, and of
which I now for a long time have feeled the loss
of. I am a native of Sweeden and have been for
a long time on the Sea before. So I am not
ignorant of the work to be done there.
Honorable sir please do me this favor and receive
the thanks of a private that now have nearly
served the country 4 years and have 2 more
to serve. I should not have written this letter
But as a last resource to recover my lost healthAnd as we all know you honors kindness to the
Soldiers I hope my prayer may not pass
unnoticed, as my all depends upon your kind-
ness

Please send an answer as soon as possible as we
very seldom stay long in one place. And forgive me
for wrting this letter. And oblige your humble
Servant Oscar L. Ekvall.
Please direct as follows,

especially them from Illinois.

<text>Samuel Alschuler, judge of the U.S. Circuit Court of Appeals for the Seventh Circuit (1915-1936), was born in Chicago, Illinois, on November 20, 1959 to Bavarian-born Jacob and Caroline Stiefel Alschuler. After growing up and attending school in Aurora, Alschuler began practicing law at the age of twenty-two in 1881 and starting in the 1890s, served as a public servant for the rest of his life. As a Democrat, Alschuler won a seat in the Illinois House of Representatives in 1896. He became the House Minority leader in 1898, a position he held until leaving the House of Representatives in 1900. Alschuler unsuccessfully ran for Illinois State Governor in both 1900 and 1912. In 1915, President Woodrow Wilson recognized Alschuler’s potential and appointed him to the U.S. Court of Appeals 7th Circuit. Alschuler served as arbitrator during the meat packing labor dispute of 1918. During the coal labor problems of 1922, President Warren Harding also asked him to serve on a coal fact-find commission. Alschuler, uncertain if he could properly be a member of the commission while serving on the federal bench, chose to serve unofficially as a legal advisor to the commission. In 1925, he became the presiding judge of the U.S. Circuit Court of Appeals, a position he held for nine years, and retired in May 1936. Alschuler was a bachelor until 1923, when he married the daughter of the Chicago clothing manufacturer Ella Kahn. On November 10, 1939, Samuel Alschuler died, having no children.

Judge Samuel Alschuler is related to the nineteenth century photographer, Samuel Alschuler. The photographer is best known for photographing Abraham Lincoln in Urbana, Illinois, in 1858 in which Lincoln wore Alschuler's black suit coat which was far too small for the political figure. Images taken by the photographer Samuel Alschuler are included in this collection.

The finding aid for the Samuel Alschuler Papers, 1890-1940 at the Abraham Lincoln Presidential Library and Museum may be found at: http://alplm-cdi.com/chroniclingillinois/items/show/23.

This collection features photographs relating to Samuel Alschuler and his family, including unidentified family members and scenes from Chile. </text>

                    <text>
Chicago June 19th 1861

His Excellency

Richard Yates

Governor of the State of Illinois

Springfield

Sir:

Some time ago I send a letter to the Right Honorable F. A. Hoffmann, Lieutenant Governor of this State, in which I offered my service to the State in any situation he or Your Excellency may see fit to place me. I did not like to join one of the Volunteer Regiments, as I have a very good business situation & a family depending from my earnings, so that I had no time to raise a Company; besides, I am not satisfied with the elections of officers in a great many volunteer regiments which seldom have elected the right men.

The latest news show my presumption being right & that the country is very much in need of experienced officers.

I have a short sketch of my life in my letter to the Right Honorable F. A. Hoffman, but in this critical period I consider it my duty to my adopted country, to communicate to You the following facts:

I was born in the year 1826 in the City of Luxembourg, where my father was commander of the Prussian Artillery; in the spring of 1844 I entered the Prussian army in the 30th Regiment of Infantry, was promoted 1846 lieutenant in the same Regiment, fought all the battles in the Revolution of 48 & 49 & therefore got decorated by the Grand Duke of Baden with the Zachringer Loewen Order; In 1853 I resigned my office on Account of not being able to give the required security to get married & came to this country. I started first in St. Louis a Alcohol Distillery & lived there till 1858, when I failed in business on account of the hard times & went to this city, where I reside since that time. I am now travelling agent for Mr. Theodore Kraefft 77 South Water street, to whom & many other leading merchants here & in St. Louis I can refer You.

From the above statement Your Excellency can see if my service could be of any use to my adopted country & I am willing & ready every minute to serve the State to the best of my ability. I have further to remark to You that I made myself acquainted with the American tactics.

I hope Your Excellency will excuse my liberty of addressing You in this matter & if You need my service please direct Your ordres care of Theodore Kraefft to

Your humble servant

Otto Igel

Otto Igel
